Possession of cocaine or heroin or trafficking in these substances can result in prison terms. Possession, trafficking in or production of amphetamines, LSD, mescaline, barbituates or anabolic steroids can also lead to jail.
If drugs were discovered after an illegal search or detention, or after a violation of your right to counsel or right to know immediately why you’ve been detained, the Crown could be persuaded to withdraw the charge. If not, you may be able to avoid conviction at trial or, instead of going to trial, work out a good plea bargain.
Frequently, possession charges are laid without sufficient evidence of knowledge and control, both of which must be established beyond a reasonable doubt to secure your conviction. Such shortcomings can lead to the withdrawal of charges or acquittal after trial.
